As reported by Law360, on January 20, 2023, U.S. District Judge William H. Orrick of the Federal District Court for the Northern District of California indicated that he expects to grant preliminary approval to a $255 million settlement resolving nationwide economic loss claims in the sprawling multidistrict federal fraud and injury litigation against Juul.
Following Friday’s hearing, Judge Orrick said he “will preliminarily approve the class settlement as fair, reasonable and adequate.”
In December, the plaintiffs asked for preliminary approval, on the grounds that the deal would end the economic loss claims even as separate deals are being undertaken for injury and other claims in the MDL and state Judicial Council coordination proceedings against Juul.
In their motion, the plaintiffs noted “that while they are confident in their claims, the continuing cost and risks of litigation make the settlement an adequate and appropriate way to finish the case.”
