Child Product Injuries
Dangerous and Defective Children's Toys and Home Products
According to the U.S. Consumer Product Safety Commission, there are about 16 toy-related deaths each year involving children under the age of 15, and over 200,000 toy-related injuries. Toys containing small, powerful magnets are dangerous to children because if two or more magnets are ingested, they may attract to each other through the intestinal wall and create perforations, blockage, intestinal twisting, infection, blood poisoning, and even death. The CPSC has issued a safety alert warning parents to be vigilant with toys containing magnets that could come loose and fall out of the product.
Children are also injured every year by unsafe home products. Often, these injuries result from inadequate, improper or absent warning labels or product instructions. For example, cribs and playpens can pose serious dangers to babies and young children. Improperly designed or weak slats can allow infants and children to become entangled, trapped, or strangled; defective bedding can lead to airway obstruction; and defective designs can allow infants to become trapped between the mattress and the side of the crib.
Legal Rights of the Injured
A personal injury action is a lawsuit brought by an individual who has suffered physical or mental harm as the result of the wrongful conduct of another. A wrongful death action is a lawsuit brought on behalf of a deceased person's family or beneficiaries that alleges the death was attributable to the willful or negligent act of another.
The laws of most states allow persons injured by the negligence of another to file a personal injury or wrongful death lawsuit against those responsible for the accident. If the personal injury was caused by a defective product, such as a child toy or infant seat, the injured person may be eligible to file a lawsuit against the manufacturer of the product.
Damages Available in Injury Lawsuits
Damages sought against negligent manufacturers for producing and selling products with safety defects and health dangers include general and compensatory damages for:
- Past and future physical pain and suffering, mental anguish and physical impairment;
- Past and future medical, incidental and hospital expenses;
- Past and future loss of earnings and earning capacity;
- Punitive damages; and
- Wrongful death when the victim was killed.
