On January 10, 2013, a former Hewlett-Packard Company ("HP") employee filed a class action lawsuit charging that HP has a common practice of misclassifying its technical support workers as exempt and failing to pay them for all overtime hours worked in violation of federal overtime pay laws.

HP employs several thousand technical support workers nationwide. Many of these employees worked at smaller companies, such as Autonomy, Palm, Electronic Data Systems (EDS), 3Com, ArcSight, and 3PAR, that have been acquired by HP in recent years.

Types of HP Workers Allegedly Deprived Overtime Pay

The lawsuits seeks to include all HP technical support workers, such as those in the following titles:

  • Technical Solutions Consultants,
  • Technical Solutions Representatives,
  • Technical Support Engineers, and
  • Senior Technical Support Engineers,
  • among others

These employees are responsible for installing, maintaining, and/or supporting computer software and hardware.

The lawsuit alleges that these workers were misclassified as exempt from receiving overtime pay in violation of federal and state law. The lawsuit seeks to recover back overtime pay for hours over 40 worked by these employees nationwide during the past several years.
